1. Introduction
Welcome to Mofawada! These Terms of Use ("Terms") govern your access to and use of the Mofawada mobile application ("App") operated by Mofawada E-Commerce W.L.L ("Company," "we," "us," or "our"), registered in the Kingdom of Bahrain under Commercial Registration Number [177421-1]. By accessing or using the App, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you must not use the App.
Mofawada acts solely as an intermediary platform that facilitates interactions, negotiations, and transactions between vendors ("Vendors") and users ("Clients"). The Company does not own, sell, or provide the products or services listed on the App.
2. Definitions
- "App" refers to the Mofawada mobile application.
- "Vendor" refers to businesses or individuals who list and sell products or services through the App.
- "Client" refers to individuals or businesses purchasing products or services through the App.
- "User" collectively refers to both Vendors and Clients.
3. Eligibility
You must be at least 18 years of age or the legal age of majority in your jurisdiction to use the App. Minors may only use the App under the supervision of a parent or legal guardian.
4. Role of Mofawada
- Mofawada is a platform that facilitates communication, price negotiation, and transactions between Vendors and Clients.
- Mofawada does not own or control any products or services listed on the App.
- Mofawada is not responsible for the quality, legality, safety, or availability of any products or services offered by Vendors.
- All agreements, negotiations, and transactions occur directly between Vendors and Clients, and Mofawada is not a party to these agreements.
- Mofawada provides features for Clients to rate and review services or products. These ratings and reviews are public and serve as feedback for Vendors. Mofawada does not verify the accuracy or fairness of reviews but may remove inappropriate content at its discretion.
5. User Obligations
Users agree to:
- Provide accurate and truthful information when registering and using the App.
- Ensure compliance with all applicable laws and regulations.
- Refrain from misusing the App, including uploading false or misleading information.
- Take full responsibility for their transactions and interactions with other Users.
- Use the App for lawful purposes only and not for fraudulent or illegal activities.
- Leave fair and honest ratings or reviews and avoid defamatory or abusive language.
6. Vendor Responsibilities
Vendors agree to:
- Provide complete and accurate information about their products or services.
- Honor pricing, terms, and conditions agreed upon with Clients.
- Fulfill orders and deliver products or services in a timely manner.
- Comply with all applicable laws, including consumer protection and data privacy regulations.
- Address and resolve disputes directly with Clients.
- Respond professionally to ratings and reviews left by Clients.
7. Client Responsibilities
Clients agree to:
- Provide accurate contact and delivery information.
- Make payments promptly and honor agreements made with Vendors.
- Inspect products or services upon delivery and report any issues directly to the Vendor.
- Use the App responsibly and avoid abusive behavior toward Vendors or other Users.
- Provide fair and constructive reviews and ratings to help Vendors improve their services.
8. Payments and Fees
- All payments are processed through third-party payment providers. The Company does not store or process payment information.
- Mofawada may charge service fees for facilitating transactions, which will be disclosed before any charges are applied.
- Users agree that Mofawada is not responsible for errors, disputes, or issues related to payment processing handled by third-party providers.
9. Dispute Resolution
- Mofawada is not responsible for resolving disputes between Users.
- Users must attempt to resolve disputes directly. Mofawada may, at its discretion, assist in communication but is not obligated to mediate disputes.
10. Prohibited Activities
Users may not:
- Use the App for unlawful purposes.
- Post false, misleading, or harmful content.
- Upload viruses, malware, or any other harmful software.
- Attempt to hack, disrupt, or interfere with the App’s functionality.
- Misuse other Users' personal or payment information.
- Post defamatory, offensive, or abusive content in reviews or communications.
11. Limitation of Liability
- Mofawada is not liable for any losses, damages, or claims arising out of transactions between Vendors and Clients.
- The Company is not responsible for the accuracy or legality of information provided by Users.
- Mofawada’s liability, in any case, is limited to service fees paid by Users within the 3 months preceding the claim.
12. Data Privacy
Mofawada collects and processes data as outlined in its Privacy Policy. Users must review and agree to the Privacy Policy before using the App.
13. Termination
- Mofawada reserves the right to terminate or suspend any User account that violates these Terms or engages in fraudulent or harmful activities.
- Users may terminate their accounts at any time by contacting support. Termination does not waive any outstanding obligations or payments.
14. Changes to Terms
- Mofawada may update these Terms at any time. Users will be notified of significant changes via email or in-app notifications.
- Continued use of the App after updates indicates acceptance of the new Terms.
15. Governing Law
These Terms are governed by the laws of the Kingdom of Bahrain. Any disputes arising out of these Terms will be resolved in the courts of Bahrain.
